- A principle, deriving from a clause of the Magna Carta (1215), now also embodied in the 5th and 14th amendments of the US Constitution, which provides that no person shall be arrested, imprisoned, banished, or in any way deprived of their rights, except by the lawful judgement of equals and according to the law of the land.
